Notice of Privacy Practices

Effective date: October 30, 2026. This notice describes how Communicating Above Barriers, LLC (CAB) may use and disclose patient health information, and the privacy rights of patients and their authorized representatives. Questions about these practices may be directed to CAB’s privacy contact below.

Communicating Above Barriers, LLC (CAB) | Pediatric speech-language therapy | Florida

Your information. Your rights. Our responsibilities. This notice explains how protected health information about a patient may be used or shared, and how the patient or an authorized parent, guardian, or other personal representative can access that information. Please review it carefully.

Who is covered by this notice?

This notice addresses patient health information created or received by CAB during screenings, evaluations, speech-language therapy, care coordination, scheduling, billing, and payment activities. It describes privacy rights and obligations under applicable law, including HIPAA where applicable. A separate Website Privacy Policy describes general website information practices.

Your rights

Obtain copies of health records

You may request an electronic or paper copy of the patient’s health records that CAB maintains in a designated record set. We ordinarily respond within 30 days, subject to lawful extensions, exceptions, and permitted cost-based fees. Ask our privacy contact how to submit a request.

Request corrections

If you believe information in the patient’s record is incorrect or incomplete, you may request an amendment. We typically respond within 60 days, subject to lawful extensions. If CAB denies a request, we will explain the reason and your available options.

Ask for confidential communications

You may ask CAB to contact you in a particular way or at a particular address. We will accommodate reasonable requests.

Request restrictions

You may ask us to limit certain uses or disclosures for treatment, payment, or healthcare operations. We are not always required to agree. When a service is paid in full out of pocket, you may request that information about that service not be disclosed to a health plan for payment or healthcare operations; we must honor a qualifying request unless a law requires disclosure.

Ask for a list of certain times we shared your health information

You or an authorized representative may ask CAB for a list showing certain occasions when patient health information was shared outside the practice during the six years before your request, including who received it and why. The list generally does not include routine sharing for treatment, payment, or healthcare operations, and other exceptions allowed by law. One list within a 12-month period is free; a reasonable, cost-based fee may apply to additional requests.

Obtain this notice and choose a representative

You may request a printed copy of this notice even if you receive it electronically. A parent, legal guardian, or other authorized personal representative may exercise rights on behalf of a patient as allowed by federal and Florida law; CAB will verify authority and respect any legally applicable limits on parental access.

Make a complaint without retaliation

If you believe a patient’s privacy rights have been violated, contact CAB using the information below or file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights at HHS OCR’s complaint page. CAB will not retaliate against anyone for making a complaint.

Your choices

In appropriate circumstances, you may direct how CAB shares information with a family member, caregiver, or another person involved in a patient’s care or payment for care. We may also share limited information in a disaster-relief situation or to prevent a serious and imminent threat, as the law permits. Please communicate any preferences or restrictions to our team.

CAB must obtain written authorization for most uses and disclosures for marketing, any sale of protected health information, and most disclosures of psychotherapy notes if such notes are maintained, unless a specific legal exception applies. Authorizations may generally be revoked in writing for future uses. If CAB conducts fundraising using protected health information, individuals must be offered the legally required opt-out.

How CAB may use or share health information

To provide treatment

We may use or share necessary information with clinicians, physicians, authorized caregivers, and other professionals involved in the patient’s care. For example, a speech-language pathologist may coordinate care with another treating professional.

To obtain payment

We may use or share information to prepare claims, check benefits, bill insurers or permitted funding programs, and receive payment. Examples include necessary information submitted to a health plan or a scholarship-related payment administrator where authorized and permitted.

To operate the practice

We may use information to schedule care, supervise services, document clinical quality, manage records, conduct permitted audits, and carry out other lawful healthcare operations. Service providers working on CAB’s behalf must meet applicable privacy and security requirements.

Other uses and disclosures permitted or required by law

  • Comply with applicable federal or state legal requirements and valid orders.
  • Report suspected abuse, neglect, or threats to health or safety when reporting is legally required or permitted.
  • Cooperate with legally authorized public-health and healthcare-oversight activities.
  • Respond to lawful workers’ compensation, law-enforcement, court, or administrative requests subject to required safeguards.
  • Make other disclosures permitted by law, including those relating to research, deceased persons, or specialized government functions when applicable.

We will not use or share protected health information for purposes not allowed by this notice or applicable law unless an authorization or another legal basis is obtained. Some Florida laws or other federal laws may impose additional protections.

Special protections for substance use disorder records

Certain substance use disorder records protected under 42 CFR Part 2 have additional confidentiality requirements. To the extent CAB receives or maintains such protected records, they generally cannot be used or disclosed in civil, criminal, administrative, or legislative proceedings against a patient without the patient’s specific consent or a qualifying court order and required legal process. Other Part 2 restrictions and patient rights apply, including special authorization requirements for certain counseling notes and applicable fundraising notices or opt-outs.

Our responsibilities

  • Maintain the privacy and security of protected health information as required by law.
  • Notify affected individuals as required if a breach compromises protected health information.
  • Follow the terms of the current adopted Notice of Privacy Practices and provide copies as required.
  • Obtain authorizations for uses or disclosures that require them and honor valid revocations for future uses.

Changes to this notice

CAB may revise its Notice of Privacy Practices as laws or actual practices change. The currently effective notice will be available upon request, at appropriate service locations, and on this website.
